In the spring of 2016 the office of Housing and Urban Development (HUD) issued guidance stating when landlords screen applicants with criminal histories several things must be taken into consideration. Landlords should:

  • Not consider arrest records that did not result in conviction;
  • Consider how long ago a conviction occurred;
  • Consider what type of crimes they will screen for as they relate to the safety of the property and other tenants; and
  • Consider an applicant’s rehabilitation.
